Terms of service
These terms govern your use of Perspicuity. By signing in, you accept them. They are short on purpose; complement them with the privacy notice, which is part of this contract.
1. The service
Perspicuity ("the service") is a structured decision-making tool operated by People and Planet Consulting Inc. ("we", "us"). It uses third-party large language models to help you walk through a decision methodology (PrOACT, Decision Quality Check-in, Issue Raising) and produces a structured decision document.
The service is offered as-is. We are a small company and the product is under active development. Features may change.
2. Your account
You sign in via an identity provider (Keycloak). You are responsible for keeping your sign-in credentials secure and for everything that happens under your account. One human, one account; you may not share or sell your account.
You must be at least 16 years old to use the service.
3. Acceptable use
You agree not to:
- Use the service to break the law, harm others, or process content you have no right to process.
- Attempt to access other users' accounts or content.
- Probe, scan, or test the vulnerability of the service without our written permission.
- Use the service to generate spam, harassment, defamation, hateful content, or sexual content involving minors.
- Use the service to render legal, medical, or financial advice that you then represent as professional advice to a third party. The service is a thinking tool, not a licensed practitioner.
- Scrape, mass-download, or extract data from the service except via the data-export feature on your own data.
- Reverse-engineer or attempt to extract weights, prompts, or other proprietary configuration of the underlying models.
We may suspend or terminate your account if you breach these terms. For clear cases of abuse, suspension is immediate.
4. Your content
You retain ownership of every decision, document, and conversation you create on Perspicuity. By using the service, you grant us a limited licence to process your content solely to operate the service for you (storing it, displaying it back to you, passing it through an LLM you are talking to).
We do not use your content for training unless you explicitly opt in. The opt-in is a separate, off-by-default toggle at signup and in Settings → Privacy. Opting out at any time stops future inclusion; data already incorporated into a trained model cannot be retracted from that model, but we will halt new use.
5. Credits and payment
Some features consume credits, which you can buy in bundles via our payment processor (Helcim). Credits do not expire. Credits are non-refundable except where required by law. Prices are in Canadian dollars, GST/HST as applicable.
We may change pricing of future bundle purchases. Existing credits already in your balance are not affected.
6. Third-party services
The service relies on third-party providers — listed at /privacy/sub-processors. We are not responsible for outages or actions of those providers, but we will tell you when an outage materially affects you.
7. Warranty disclaimer
The service is provided as-is and as-available, without warranty of any kind, express or implied — including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Outputs from the LLM may be wrong, incomplete, or biased. You are responsible for any decision you act on.
8. Limitation of liability
To the maximum extent permitted by applicable law, our aggregate liability for any claim arising out of or relating to your use of the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) CAD $100. We are not liable for indirect, incidental, consequential, special, or punitive damages.
Nothing in this section limits liability that cannot be limited under applicable law (including consumer protection law and liability for gross negligence or wilful misconduct).
9. Termination
You may close your account at any time from your profile's Danger zone. We may suspend or terminate your account for breach of these terms, or wind down the service with at least 30 days' notice (during which we will provide a final data export).
10. Governing law
These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. Disputes are subject to the exclusive jurisdiction of the courts of Ontario, except where mandatory consumer-protection law in your country of residence grants you a more favourable forum.
11. Changes to these terms
If we change these terms materially, we will email you before the change takes effect and require you to re-accept them. Minor edits (typos, clarifications) are made silently; the Last updated date at the top reflects the most recent revision.
